Terms

Legal

Effective 8 September 2026 · Version 2.0. These terms cover use of borelogix.com. Use of the Waterwell IQ™ platform is governed by the separate written agreement with your organization, which takes precedence over anything on this page.

What these terms cover

They cover this website: the pages, the field notes, the calculators, the demonstration district, the downloadable examples and the site assistant. They do not cover a district’s live workspace, its data, service levels, support or fees — those live in the district’s agreement. Where the two ever disagree, the agreement wins.

The calculators and the demonstration district

The pump energy calculator runs the same engine as the platform, but only on the handful of numbers you type in. It is an indication, not a pump test, and not engineering advice. Do not commit capital on the strength of it — commission a test.

The demonstration district, its wells, and the example reports you can download are synthetic. They are built to show what the platform produces, using constructed data. They are not a real utility, not a real assessment, and must not be presented to anyone as a measurement of an actual well.

No engineering, legal or financial advice

Nothing on this site is engineering advice, legal advice or financial advice, and nothing here substitutes for a licensed professional engineer, your own counsel, your records officer, or your groundwater sustainability agency’s technical consultant. Decisions about rehabilitating, re-pumping, deepening, destroying or funding a well are yours, made with people who carry professional liability for them.

Accuracy, standards and dates

We describe the platform as it is, including what is not built yet. Where a page refers to a standard, a regulation, a reporting deadline or an agency requirement, it is a summary written to be useful, not a legal determination — deadlines carry basin and water-year exceptions, and agency guidance changes. Confirm anything you rely on against the primary source or with your counsel. We correct these pages when we learn they have drifted.

Acceptable use

You may read this site, use the calculators, explore the demonstration district and download the examples for your own evaluation, and quote us with attribution. You may not:

  • probe, scan or test the security of this site or the platform without our written permission — if you find something, tell us at [email protected] and we will thank you;
  • scrape the site or the demonstration district at volume, or use automated means to extract the content in bulk;
  • use the content, the demonstration district or the example reports to train a machine learning model;
  • present synthetic examples as real measurements, or represent our output as your own professional assessment;
  • enter another person’s information, credentials, or confidential district data into the site assistant.

Our intellectual property

The Waterwell IQ™ scoring, diagnosis and lifecycle models, the software that runs them, the report designs, the template kit, the site content and the BoreLogix and Waterwell IQ names and marks are ours and stay ours. Nothing here grants a license to them beyond reading and evaluating this site.

In particular, you may not reverse engineer, decompile or disassemble the platform or its engine, nor attempt to derive the models by systematically probing the calculators or the demonstration district with constructed inputs; nor use the platform or this site to build or assist a competing product, or to compile a public benchmark, comparison or ranking of it, without our written agreement. A district’s own records and the reports generated from them are the district’s — this clause is about the machinery, not the output.

Links to other sites

We link to agencies, standards bodies and manufacturers because they are the primary source and you should go and read them. We do not control those sites and are not responsible for what they say or do.

Availability and warranties

This website is provided as it is. We work to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose, and we disclaim implied warranties to the extent the law allows. Platform availability and service commitments are set out in the district’s agreement, not here.

Limitation of liability

To the fullest extent the law allows, BoreLogix is not liable for indirect, incidental, special or consequential loss arising from your use of this website, including lost profits or lost data. Nothing in these terms limits liability that cannot lawfully be limited — including for fraud, or for death or personal injury caused by negligence. Liability arising under a district’s agreement is governed by that agreement.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in Riverside County, California have exclusive jurisdiction over disputes about this website. Nothing here overrides a dispute-resolution or venue provision agreed with a public agency in its own contract.

Changes

We update these terms from time to time and change the effective date and version at the top. Continued use of the site after a change means you accept the current version.
